Welcome to AgatebayLLC! These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our site, you agree to comply with these Terms. If you do not agree, please do not use our services. 

1. General Conditions

  • You must be at least 18 years old to use our services.

  • We reserve the right to refuse service to anyone at any time for any reason.

  • You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of our services without express written permission from us.

  • Unauthorized use of our website may give rise to a claim for damages and/or be a criminal offense.

2. Products & Pricing

  • Prices and availability of products are subject to change without prior notice.

  • We reserve the right to modify or discontinue any product without liability.

  • We do not guarantee that product descriptions, pricing, or other content is error-free. If we discover an error, we may correct it and revise your order accordingly or cancel the order.

3. User Accounts & Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.

  • We are not responsible for any unauthorized access to your account. Any activity occurring under your account is your sole responsibility.

  • We reserve the right to terminate accounts that violate our Terms or are engaged in fraudulent activity.

4. Orders & Payments

  • We reserve the right to refuse or cancel any order at our discretion.

  • If your payment method is declined, we may cancel your order.

  • Sales tax and additional fees may be applied where applicable.

5. Refund & Return Policy

  • To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase. Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

  • Returns are accepted within 14 days of delivery, provided items are unused and in original packaging.

  • Refunds are processed within 7 days after we receive and inspect the returned item.

  • Exchanges for defective or damaged items must be requested within 14 days.

  • If your return is accepted, we will send instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

  • Certain types of items cannot be returned, like perishable goods (such as food, flowers, or plants), custom products (such as special orders or personalized items), and personal care goods (such as beauty products). We also do not accept returns for hazardous materials, flammable liquids, or gases. Please get in touch if you have questions or concerns about your specific item. Unfortunately, we cannot accept returns on sale items or gift cards.

  • We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too. If more than 15 business days have passed since we’ve approved your return, please contact us via the given contact information under 12.

6. Shipping Policy

  • Orders are processed within 14 business days and shipped via selected carriers.

  • Delivery times vary based on location and shipping method.

  • We are not responsible for lost or stolen packages once delivery is confirmed.

  • Notwithstanding the above, if the merchandise is being shipped into the European Union, you have the right to cancel or return your order within 14 days, for any reason and without a justification. As above, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

  • All content on this website, including text, images, logos, and trademarks, is the property of AgatebayLLC and protected by applicable copyright laws.

  • You may not use, reproduce, or distribute our content without our written consent.

8. Limitation of Liability

  • We are not liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of our services.

  • We do not warrant that our services will be error-free, secure, or uninterrupted.

9. Indemnification

  • You agree to indemnify and hold AgatebayLLC harmless from any claims, liabilities, or damages resulting from your violation of these Terms.

10. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the State of Arizona.

  • Any disputes arising out of these Terms shall be resolved through arbitration in Arizona, unless otherwise required by law.

11. Changes to Terms

  • We reserve the right to update these Terms at any time.

  • Your continued use of our services after changes signifies acceptance of the revised Terms.
